The insured named in the schedule of Membership form and carrying on the Profession described in the said schedule has applied to M/s. DOCLEGAL CONSULTANTS PRIVATE LIMITED for the purpose of taking Indemnity through them from The Oriental Insurance Company Limited and all the legal and other Services from the Primary Company (i.e. DOCLEGAL CONSULTANTS PRIVATE LIMITED) and for this purpose the membership form contain the written proposal and declaration which is on the basis of this contract and is deemed to be incorporated herein and the membership deposit has been made for or on account of Indemnity Insurance and Services. Now this membership contract witnessed that subject to the terms, exceptions and conditions contained herein or endorsed here on the company (DOCLEGAL CONSULTANTS PRIVATE LIMITED) will provide the Indemnity Insurance Policy on yearly renewal basis from its Primary Insurer The Oriental Insurance Company Limited and all the services as mentioned under. The services include all the defense costs fees and expenses anywhere in India and in accordance with Indian law.

SERVICES

  1. Any type of legalities may be in any court of India- means if our doctor is sued for his professional negligence in any court set by the Indian law. He/she entitled to get our free service or legal support.
  2. The cases arising from ‘Police Stations’ means any case which is being informed or registered to police and then is sent to court is covered. The company will arrange every legal support through its lawyer including to the bailing out of our member and further proceedings in any court up to Supreme Court of India. (Up to Supreme court of India means that if any judgment is passed from any court and if our member feels unsatisfied from the judgment, the same will be challenged in the upper court on the consent of our member and that too free of cost like this we give our doctor members the flexibility of going up to Supreme level for fair judgment free of cost.)
  3. The company also declare to cover any other case of our doctor member means any other case apart from professional negligence under which our members are implicated or harassed in these conditions also our member/ doctor can avail of our free services (legal)
  4. The company will also provide free legal support if any of our member/ doctor wants to file any defamation suit or counter case to protect his/ her dignity against any person or establishment.
  5. The company provides round the clock help line numbers. So that our doctor/member can instruct us for any help.
  6. The company also declares to provide its legal consultants for counseling on any matter or for any advice.
  7. The company will provide policies through its local branch of Primary Insurer so that the doctor/members can get total transparency of assessment or interactions.
  8. The company will also hold seminars / webinars on updates of total medico legal cases time to time so that our doctor/members are aware of latest happenings.
  9. The company also agrees to provide local lawyer so that he can be asked to be present at the time of any required help.
  10. Any type of case pertaining to Labour Court, (Employees Problem etc) Civil Court or any other matter is covered under our services but the ‘Cause of Action’ should fall within the covered tenure.
